Terms & Conditions Between Livewithlocals.com & Accommodation Provider

A. The terms and conditions stipulated herein is a legally binding agreement between Livewithlocals.com and the applicant of services offered by Livewithlocals.com.

B. Definitions

1. The Company, means: Livewithlocals.com (Pty) Ltd, located at 210 Medical Suites, 27 Goldman Street, 1709 South Africa, hereafter referred to as Livewithlocals.com.

2. The Applicant means: the person, or persons, who have applied for the service, who have completed the application form with their contact details, residential details, full names, and other relevant information.

3. The parties, means: the company and the applicant, both individually and collectively.

4. The business means: provision of the service via the applicant and its property.

5. The property, means: the physical dwelling space where the guest will be booked, accommodated and cared for by the applicant.

6. Listing fee means: the annual payment of up to R750,00, which the applicant will pay over to the company so the property can be listed to receive the service.

7. The Livewithlocals.com bank account: means ABSA Bank Account Number: 21452084

8. Services, means: the outsourcing and allocation of daily accommodation rental services to accommodate local and international travelers at the property.

9. Guests, means: the person or persons, or traveler who will seek the service and who will be secured by the company via the website.

10. The Application form: means, the legal form which will be used by the applicant to list the property and to secure an agreement term with the company.

11. Bookings, means: the guest’s accommodation schedule which will be issued to the applicant and property by the company.

12. Booking schedule, means: the dates and times of the guest’s arrival and departure requirements of their visit.

13. Booking fee, means, a once-off fee of R230,00 will be charged to the Applicant, for every Guest booking allocated to the property.

14. The criteria, means: the physical requirements adhered to by the property which includes: the property must be in a clean and tidy condition (subject to evaluation by the company), a landline telephone, a private bedroom for the guest, 24-hour access to a television for the guest, the property must be very close to public transportation, monitored security of the property may be required

15. The listing date, means: the date that the property will be registered on the company’s website and on the company’s marketing database and the travel operator and travel agent databases.

16. Agreement term, means: a period of 12 (twelve) consecutive months, starting from the listing date. Unless either one of the parties provide the other with a written indication to discontinue the agreement renewal three (3) months before the twelve [12] month term, the agreement will automatically be extended. In the event of any extension, the applicant will be liable to pay the listing fee within 30-days of the renewed agreement term.

17. Value added services, means: services offered to the guest which may include transportation, entertainment-chaperoning, sightseeing-chaperoning, and travel & medical insurance. More services may be added from time to time at the discretion of the company.

C. The applicant is desirous of listing his/her property for the provision of services to guests. By completing and submitting the application form, the applicant confirms his/her commitment, knowledge and consent of their agreement with the company.

D. By receiving the application form and listing the property, the company confirms their commitment, knowledge and consent of their agreement with the applicant.

E. The applicant will offer and provide the property for the use of the service, exclusively to the company. The applicant will not be allowed to offer the property to any other company for the same or similar services.

F. The applicant will be allowed to provide additional value added services to the guest as prescribed and regulated by the company.

G. The applicant will not attempt, entertain or allow for the guest to directly contact them, for the reason of acquiring the services, unless facilitated and booked by the company and proven so by a booking schedule.

H. The applicant commits to paying their first agreement term listing fee within 48 hours after their submission of the application form, and within 30-days of the renewal of agreement term thereafter.

I. The parties will adhere to the conditions of the agreement for the duration of the agreement term.

J. The company warrants that it is authorized to be an operator and provider of the business based on the company’s agreements with local and international travel agencies who have committed, to market the property to their clients.

K. The company will endeavor to place bookings at the property as frequently as possible and warrants that they will embark on aggressive and comprehensive marketing and advertising, both locally and internationally to maximize the potential of bookings with the property.

L. The applicant and the property must ensure that they meet the criteria, before or by the listing date.

M. The applicant will owe and pay over to the company, via a method which will be recommended by the company, the boarding royalty.

N. The parties consider the agreement to be legally binding for the duration of the agreement term.
